The new class action lawsuit against tobacco manufacturers

U.S. District Judge Jack Weinstein in Brooklyn made the ruling on a 2004 lawsuit that alleges Philip Morris, R.J. Reynolds Tobacco, Lorillard Tobacco Co. and other defendants duped smokers, and responded to consumers' mounting health concerns with a campaign of deception designed to preserve revenue. Now the case has been accepted for class action. This means anyone who is or has been a smoker of lights cigarettes can join the lawsuit and demand economic compensation for the damages suffered as a result of smoking this type of cigarettes. Members of the "class", that means, any smoker of lights cigarettes (now or in the past) may also be eligible for a class action lawsuit loan allowing them to be part of the lawsuit and most probably get economic compensation from the tobacco industry.

Lawyers had asked United States District Judge Jack Weinstein to allow millions of Americans to seek compensation for damages up to USD 200 billion, over industry claims that light cigarettes were less harmful than ordinary cigarettes. The plaintiffs had said that the industry knew there were no significant health differences between the two products. The judge has ruled that the lawyers were actually right, so an opportunity has been created for millions of Americans to jointly sue the manufacturers of lights cigaretters and obtain a presumably high amount of money in compensation.

The argumentation line is that consumers paid for cigarettes which were supposed to pose less of a health risk than others. Instead, the so called lights cigarettes have been proved to be equally risky or even riskier than their regular equivalents.

One of the main differences in this class action lawsuit case is that the case for an alleged racketeering offence is very likely to ge through the process. In a recent ruling in another government racketeering case against the tobacco manufacturers, United States District Judge Gladys Kessler concluded that the tobacco industry misled its consumers, the smokers, by using words like "light" and "mild" to describe their cigarettes and sell them better than their ordinary counterparts. Kessler ruled that the tobacco industry "distorted the truth about low tar and light cigarettes so as to discourage smokers from quitting... They suppressed research. They destroyed documents. They manipulated the use of nicotine so as to increase and perpetuate addiction."

The tobacco companies had argued that the class action should not be certified because each smoker has health claims and circumstances that are unique. Nevertheless, experts in class action lawsuits conclude that it is now impossible to reverse the ruling making this case a class action lawsuit, which can now be joined by any current or past smoker of lights cigarettes.

i was born with asthma, my sister and i both ! i am 55 years old,my sister is 53.i remember as a 11,12 years old , the man that delivered cigarettes, delivered some other tobacco products. we lived in the country most all out lives. i would ride ,mostly walk,didn't have strength to ride or any kind of activities ! the man who stocked the little country store,he would give me several packs of little boxes of cigarettes that had abut 5 to the pack. i thought it was o k everyone else was smoking ! everyone thought it was cool. except my who had to take us to the doctor 2,3 sometimes 4 times a week in the middle of the night. i could not stop.i was 11 or 12 and i had to have a smoke.my sister i had it 4times would smoke sometime, but she had asthma so bas, i remember at13, asking the LORD to let me die, because i was choking to death. we hat to stay on that pirmitine mist years. i still carry a inhaler around with me sometimes and i would NEVER , LEAVE HOME WITHOUT IT. i have finally quit now for a few years and with GOD,s help i will still never smoke again. i was a regular smoker at the age between 13 AND 14. I WOULD TAKE MY MAMA,S OR MY DADDY,S . YES, EVERYONE SMOKED ! IT WAS SAID IT WAS OK TO SMOKE !I WAS WAS GIVEN , ,I CAN'T REMEMBER IT WAS SO LONG AGO , BUT I KNEW IT WAS COOL BUT AT NIGHT I WOULD CHOKE SO VERY BAD. I SMOKES ANYTHING I COULD GET ,BORROW ,BEG OR STEAL.i am sorry to the people i stole from. i never stole nothing in my life that i can remember but cigarettes ! i changed to merit ultra lights 100's in my late 30,s early40,s ! it didn't do no good , smoke was smoke. i tried not to smoke around my kids or let anyone do it but it was to late by then i thought. the way i finally quit, i had a bleeding ulcer and nephohomia .i had it 4 times in about 3 years. that was te way i stopped. i would even try another , same thing. the dr. said he found a spot o my right lung and and after i quit, it never got no bigger after a long time, the dr. said it looked like it turned into scar tissue i guess .i do pretty good nor. but i wan to that all the tobacco company's for trying to kill us all. the one thing i had againts it was my friends started too !! why wasn't it made to stop those killers ?? i had to have one after i ate, drink a beer,played the guitar i got where i could hardly sing anymore. i try now to play and sing at church! makes me sick to see the young people smoking !thats enough for me know,

my husband an i smoke light cigarettes because we though they was less harmful. but in fact it seems to be more harmful.becuse you have to pull so hard to get the taste they made me and my husband lung congested more than the stronger brand carol and howard dixon

I THINK THIS HAS BEEN A LONG TIME COMING. I STARTED OUT SMOKING BENSON AND HEDGES MENTHOL IN 1978 AND SOON AFTERWARDS THEY INTRODUCED BENSON AND HEDGES MENTHOL LIGHTS TO THE PUBLIC AND I HAVE BEEN SMOKING THEM EVER SINCE. I KNOW FOR A FACT I STARTED SMOKING AT AGE 23, NEVER HAVING SMOKED BEFORE, NOT EVEN AS A TEENAGER. BUT, THE CIGARETTE COMPANIES GLAMORIZED IT ON TV DURING MY FAVORITE MOVIES WITH THE LIKES OF BETTY DAVIS. IT WAS A TRICK AND I FELL FOR IT.

From what I know and this article here confirms it all of us, who have been light cigarettes smokers and are now having health problems as a consequence of that, may be now in position to take part in this major lawsuit against tobacco companies such as Philip`Morris USA. I understood that one of the light tobacco plantiffs lawyers is a certain Michael D. Hausfeld but I haven't been able to get more details about the attoreny's office he works for. Then I figured that if I consult this with a friend's wife who is attorney here in Newport, she might be able to obtain me the information on this lawyer's bar. Anyone at Lawsuit Loan has any idea how should we proceed if we want to join this lawsuit? Do you think my strategie is well put or should I do things differently? Thanks, John.

I totally agree with the fact that light cigarettes doesn't low the chances to get cancer. Only the taste is a little bit different, you don't feel them as strong as they feel the regular ones. So, the lawsuit against this type of cigarettes is a just one. Good for them!

Let's all unite in the action lawsuit against the so called lights cigarettes. they proved to be more harmful or just as harmful (depending on the brand). They made me remain a smoker, but their poison only tasted softer. It wasn't. I demand to be economically compensated for medical care, psychological aid and lesser life expectancy. Join the action lawsuit if you also fell in their trap and believed that smoking lights was less harmful.
